Jenny Carson Travel, LLC Terms and Conditions
Effective Date: May 1, 2025
These Terms and Conditions ("Agreement") govern your use of services provided by Jenny Carson Travel, LLC ("Agency," "we," "us," or "our") located in Saline County, Arkansas. By making a booking with us, you ("Client," "you," or "your") agree to these Terms and Conditions.
1. Agreement Overview
1.1 Legal Compliance:
All services provided by Jenny Carson Travel, LLC are governed by Arkansas state law. These terms are designed to comply with Arkansas' consumer protection regulations, including but not limited to the Arkansas Consumer Protection Act.
1.2 Modifications to Agreement:
Jenny Carson Travel, LLC reserves the right to modify these Terms and Conditions at any time. Any changes will be effective upon posting, and you will be notified of substantial changes. Continued use of our services after such modifications implies acceptance of the new terms.
1.3 Client Responsibilities:
As a client, you are responsible for ensuring that all information provided to Jenny Carson Travel, LLC is accurate. You are also responsible for adhering to the rules and regulations of the destination(s), as well as complying with any Arkansas state laws regarding travel.
2. Booking and Payment Terms
2.1 Booking Process:
All bookings require a completed intake form and confirmation from Jenny Carson Travel, LLC. Jenny Carson Travel requires a $150 Research fee for packaged travel United States Travel (Hotel, Flights, Car Rental, and Insurance Quote if requested) Custom itineraries in United States with the exemption of Alaka and Hawaii requires a $250 Research fee (up to 7 hours). International Custom Itineraries which includes Alaska and Hawaii requires a $300 Research fee (up to 7 hours) Additional $60 Research fee per hour will be included for Custom Itineraries that requires 8 or more hours to research. Bookings are not confirmed until the fee is received and cleared.
All Custom Itereraries are unique and require me to research your destination to find the best accommodations, transfers, tours, excursions, and other components. Vetted and updated. It typically takes me 7 business days to do my research dependent on clients' preferences and complexity of itinerary.
2.2 Deposits and Final Payments:
A deposit of [percentage or amount] is required to secure your booking dependent upon suppliers required deposits. Final payment is due by date of suppliers terms before the travel departure date. Arkansas consumer protection laws mandate that deposits for travel services must be clearly disclosed to clients prior to booking confirmation.
2.3 Accepted Payment Methods:
We accept authorized credit cards and authorized debit cards. Jenny Carson Travel, LLC does not accept personal checks, CashApp, or wire transfers. Payments made by credit card are subject to applicable fees and chargebacks, as per Arkansas law regarding electronic transactions.
2.4 Declined Payments:
If a payment is declined, the Client will be notified immediately. In the event of a chargeback or payment dispute, Jenny Carson Travel, LLC may take legal action to recover any unpaid amounts, as per Arkansas' guidelines for business transactions.
3. Cancellations
3.1 Cancellation by Client:
Cancellations must be made in writing and are subject to cancellation fees. The following cancellation fees apply:
$100 fee for cancellation 30 days before trip departure. $200 cancellation fee for cancellation of trip 15 days prior to departure date. $300 cancellation fee for cancellations 5 days prior to departure. $350 cancellation fee for cancellations made less than a day from a departure date. No RESEARCH fees will be REFUNDED regardless of Cancellation date.
3.2 Cancellation by Agency: Jenny Carson Travel, LLC reserves the right to cancel a booking due to circumstances beyond their control. In such cases, we will provide a refund or offer alternative arrangements. If the cancellation is due to a breach of these Terms by the Client, refunds will be processed according to our cancellation policy.
3.3 Refunds:
Refunds are processed within [14 days to 30 days] after cancellation confirmation. Refunds may be subject to service fees as stipulated by the suppliers and vendors we work with. Under Arkansas law, clients are entitled to a refund if services are not provided as described, unless an alternative solution is offered.
3.4 Travel Insurance:
Travel insurance is strongly recommended. We offer travel insurance options through third-party providers. Please review the policy terms and conditions carefully. Travel insurance is non-refundable and must be purchased at the time of booking unless otherwise specified by the provider.
4. Privacy and Data Protection
4.1 Client Information:
All personal information provided by clients will be kept confidential and will only be used to process bookings and provide travel-related services. We comply with Arkansas' privacy laws and federal regulations, including the General Data Protection Regulation (GDPR) where applicable.
4.2 Data Sharing:
We will not share your personal data with third parties except when necessary for travel bookings and accommodations, in compliance with Arkansas privacy laws.
4.3 Data Retention:
Your personal data will be retained for 1 year in accordance with Arkansas state laws for business recordkeeping purposes. You may request the deletion of your data at any time, subject to business retention requirements.
5. Client Conduct and Responsibilities
5.1. Professional Conduct and Mutual Respect
Jenny Carson Travel is committed to providing exceptional service in a respectful, professional, and inclusive environment. Clients are expected to conduct themselves in a courteous and respectful manner throughout all interactions, including but not limited to communications via phone, email, social media, or in-person meetings.
5.2. Unacceptable Behavior
The following behaviors are deemed unacceptable and may result in termination of services:

Harassment, abuse, or threatening behavior directed at Jenny Carson Travel, LLC representatives.

Repeated unreasonable demands or refusal to follow advised booking protocols.

Use of discriminatory, offensive, or defamatory language.

Engaging in slander (spoken false statements) or libel (written false statements) about Jenny Carson Travel, LLC or its representatives with the intent to harm reputation or business integrity.

Public or private false accusations that result in material or reputational harm.
5.3 False Accusations, Defamation, and Public Retraction Clause
1. Defamatory Statements: Slander and Libel
Clients agree to refrain from making false or misleading statements—verbally (slander) or in writing (libel)—that could harm the reputation, business integrity, or public perception of Jenny Carson Travel or its representatives. This includes but is not limited to statements made:

On social media platforms

In online reviews

Via email or text messages shared with third parties

In person or in group forums
2. Retraction of False Claims
In the event false or misleading claims are made publicly, the client agrees, upon written request from Jenny Carson Travel or its legal counsel, to:

Retract such statements in a manner reasonably equivalent in prominence and audience reach as the original claim.

Issue a correction or clarification that is truthful and factual, as mutually agreed upon or legally required.

Remove or delete defamatory content where possible.
3. Legal Rights and Remedies
Jenny Carson Travel, LLC reserves the right to pursue legal remedies under Arkansas defamation law, which may include but is not limited to:

A formal request for public retraction

Issuance of cease-and-desist letters

Filing a claim for defamation where the false statements have resulted in quantifiable harm to reputation or business interests
4.Clients acknowledge that reputational damage caused by false public claims may entitle Jenny Carson Travel to seek damages and injunctive relief as allowed by law.
Jenny Carson Travel reserves the right to cancel, refuse, or discontinue services to any client whose behavior violates this agreement. If such conduct results in a cancellation:

The client will be provided with written notice outlining the reason for termination.

Refunds or reimbursements will be handled in accordance with the cancellation terms applicable to their specific bookings at the time of termination.

Jenny Carson Travel is not responsible for any additional costs the client may incur as a result of service cancellation due to behavior violations.
5.5 Customer Public Feedback
Constructive feedback is welcomed. However, clients agree not to post false or misleading public reviews, ratings, or statements that could unfairly damage Jenny Carson Travel’s reputation. The agency may request corrections or takedowns of such content where applicable and reserves the right to respond publicly to such claims.You agree to behave in a manner that does not disrupt or endanger the safety and well-being of others. Jenny Carson Travel, LLC may cancel your trip without refund if your behavior violates any rules or regulations set by service providers or government authorities, in accordance with Arkansas law.
5.6 Defamation and Slander:
Clients agree not to engage in any activity that defames or discredits Jenny Carson Travel, LLC. In accordance with Arkansas defamation law, any actions of slander or libel against the agency may result in legal action.
6. Dispute Resolution
6.1 Mediation:
Any disputes arising from this Agreement will first be subject to mediation, in accordance with Arkansas' preference for dispute resolution. Both parties agree to mediate any issues before pursuing legal action.
6.2 Arbitration:
If mediation fails, disputes will be resolved through binding arbitration in Saline County, Arkansas, in accordance with Arkansas state law.
6.3 Governing Law:
This Agreement is governed by the laws of the State of Arkansas. Any claims or disputes will be resolved under Arkansas jurisdiction.
6.4 Attorney’s Fees and Costs:
In the event of a legal dispute, the prevailing party may be entitled to attorney’s fees and associated costs, as determined under Arkansas law.
7. Modifications to Travel Arrangements
7.1 Modifications by Client:
Requests for changes to your travel arrangements must be submitted in writing within 100 days of departure date. Modifications are subject to availability and may incur additional charges as specified by the service providers. Arkansas law requires that any material changes in bookings must be disclosed, and clients should be informed of any resulting cost increases.
7.2 Modifications by Agency:
In the event that Jenny Carson Travel, LLC is forced to make substantial changes to your travel itinerary, we will inform you as soon as possible and provide alternative solutions. If we are unable to offer an alternative, a full refund will be issued in compliance with Arkansas consumer protection laws.
8. Force Majeure
8.1 Force Majeure Events:
Jenny Carson Travel, LLC is not liable for delays, cancellations, or alterations to travel plans resulting from events beyond our control, such as natural disasters, strikes, pandemics, or government restrictions. In such cases, we will make reasonable efforts to find alternatives, but our liability is limited as allowed by Arkansas law.
9. Limitation of Liability
9.1 Limitation of Agency Liability:
Except as otherwise provided by law, Jenny Carson Travel, LLC’s liability is limited to the cost of the services provided. Jenny Carson Travel, LLC is not responsible for any indirect or consequential losses, including but not limited to lost profits, missed connections, or emotional distress, as permitted by Arkansas law.
9.2 Suppliers’ Liability:
Jenny Carson Travel, LLC acts as an intermediary between clients and suppliers. We are not liable for the actions or omissions of third-party suppliers, including but not limited to airlines, hotels, and tour operators.
10. Use of Loyalty Points, Rewards, and Frequent Flyer Miles
10.1. Client Authorization and Program Access
Clients may request that Jenny Carson Travel assist in booking flights, accommodations, or other services using their loyalty points, frequent flyer miles, hotel rewards, or other third-party travel credit programs. By doing so, the client:

Authorizes Jenny Carson Travel to access and manage such programs on their behalf.

Acknowledges that all account login information provided is correct and authorized for agent use.
10.2. Limitations and Availability

Jenny Carson Travel cannot guarantee availability or pricing when using loyalty programs, as these are subject to the terms, limitations, and availability dictated by the program provider (airline, hotel, cruise line, etc.).

Loyalty program rules may restrict changes, refunds, or upgrades, and Jenny Carson Travel is not liable for any losses or limitations imposed by the reward program provider.
10.3. Service and Booking Fees

A non-refundable Loyalty Redemption Service Fee will apply for each booking made using loyalty points or similar programs. The fee amount will be disclosed in advance and varies based on the complexity of the redemption process.

This fee compensates for the time, expertise, and administrative work required to research, plan, coordinate, and confirm bookings using client-provided loyalty currencies.

Fees are due at the time of service and are not contingent on reward program approval or availability.
10.4 Loyalty Points and Eligibility

Clients are solely responsible for knowing their loyalty program’s rules and eligibility.

Jenny Carson Travel, LLC is not responsible for loss of points, expired miles, or the inability to complete a booking due to insufficient balances or program restrictions.

Clients must verify that their program allows third-party bookings. Any breach of the loyalty program’s terms is the sole responsibility of the client.
10.5 Legal Compliance
This service is offered in accordance with Arkansas state business and consumer protection laws. Jenny Carson Travel operates as a travel planning service and does not act as a representative of any loyalty program. All efforts will be made to ensure transparency and proper documentation of services rendered. Acknowledgment:
By booking with Jenny Carson Travel, LLC, you acknowledge that you have read, understood, and agreed to these Terms and Conditions, including the provisions on cancellations, refunds, and dispute resolution.
